Present: Mayor Vincent Battista, Deputy Mayor Barbara Boulton, Trustee Molly Reilly, Trustee James Bray and Trustee Dan Frechette. Absent: Treasurer Jim Yuhas.

 

The Meeting was called to order at 6:30 pm with the Pledge of Allegiance.

 

REVIEW OF MINUTES

The minutes from the March 14, 2017 meeting were approved as presented in a motion made by Trustee Reilly and seconded by Trustee Bray. Vote 5 ayes (Battista, Boulton, Bray, Reilly and Frechette), 0 nays.

The minutes from the March 20, 2017 meeting were approved as presented in a motion made by Trustee Reilly and seconded by Deputy Mayor Boulton. Vote 5 ayes (Battista, Boulton, Bray, Reilly and Frechette), 0 nays.

The minutes from the April 6, 2017 meeting were approved as presented in a motion made by Trustee Reilly, seconded by Trustee Bray. Vote 5 ayes (Battista, Boulton, Bray, Reilly and Frechette), 0 nays.

 

A public hearing was opened at 6:33 pm for the 2017-2018 Village Budget. No comments were offered.

 

A public hearing was opened at 6:34 pm for the proposed amendment to the Madison Barracks PDD involving Mark Crandall’s application for a change in use of his building at 100 Vollum Rd. No comments were offered.

Local Law No. 1 of the Year 2017 was presented amending Local Law No. 2 of the Year 2014 (The Village of Sackets Harbor Zoning Law of 2014) and Local Law No. 4 of the year 2001 providing for an update of the Madison Barracks Planned Development District and is attached to these minutes. The Resolution accepting Local Law No 1 of 2017 was introduced and read into the minutes by Mayor Vincent Battista:

 

WHEREAS, the Village of Sackets Harbor, in order to protect and promote public health, general welfare, safety, comfort, convenience, economy, as well as the Village’s natural, agricultural, aesthetic, historic, and cultural resources, and to implement the community’s goals as expressed in the Village of Sackets Harbor comprehensive plan, as such plan may be modified from time to time, has undertaken the amendment of the Local Law No. 2 of 2014 (Village Zoning Law of 2014), and Local Law No. 4, of 2001, allowing a change in the permitted uses of a single parcel in the Madison Barracks Planned Development District(PDD), at the request of Mark Crandall, the owner of that parcel;  and

            WHEREAS, the Village Planning Board has reviewed the proposed amendment to the Madison Barracks PDD and recommended approving the amendment of the Village Zoning Law, and said Planning Board having provided the Village Board with its recommendations for minor amendments to the Village Zoning Law and the Madison Barracks PDD map, consistent with the recommended amendments;  and

            WHEREAS, an environmental assessment of the proposed amendment was conducted in accordance with the State Environmental Quality Review Act (6 NYCRR Section 617.3, 617.4, et seq.) and a negative declaration was issued after notice and due deliberation; and

 

            WHEREAS, public hearings on the proposed amendments were held on February 14, 2017 and April 11, 2017, and attended by a quorum of the Village Board; and

            WHEREAS, the proposed amendments have been reviewed by the Jefferson County Planning Board, which board did not make any objection or revisions to the amendments.

            NOW, THEREFORE,

            BE IT RESOLVED, that pursuant to the authority and power granted by the Municipal Home Rule Law of New York State, Articles 2 and 3, and Village Law of New York State, Section 7-708, Local Law No. 2 of the year 2014, titled the Village of Sackets Harbor Zoning Law, and the amended zoning map incorporated therein, are hereby amended and shall be presented for and effective upon filing with the Secretary of State by the Village Clerk; and further

            BE IT RESOLVED, that pursuant to Village Law of New York State, Section 7-706(5), that a copy of the aforesaid local law and a description of the map incorporated therein shall be entered in the minutes of the Village Board; a copy of the law and map shall be posted at the Village offices, and affidavits of publication filed by the Village Clerk.

MAYORS REPORT

Mayor Battista reported that the Certificate of Completion has been received from the NYS DEC for the LDC property. Trustee Frechette and Trustee Reilly will work with Don DeMonda on the marketing plan for the property.

The Mayor also received an update from Jennifer Gaffney from SH School who is working with Officer Paul Trudeau on a presentation on the topic of combating drug use.

The spring get-together for employees and volunteers will be April 27.

The Fire Committee report was given to the Board members. The Department has been very busy lately.

There was a moment of silence in memory of Fire fighter Garrett Loomis on the 7th anniversary of his death.

Correspondence was received from Cassandra Rucker reporting that the Polar Plunge held in the Village raised $14,597.00

A letter from Peyton Taylor from the NYS Parks outlining their proposed changes to the Main St. entrance to the Battlefield Site was reviewed.

NEW BUSINESS

The 2017-2018 Budget, which has no increase in taxes or water rates, was approved in a roll call vote from a motion made by Mayor Battista, seconded by Trustee Reilly. Vote 5 ayes (Battista, Boulton, Bray, Reilly and Frechette), 0 nays.

The Event application for the 18.12 Challenge and ½ Marathon was approved in a motion made by

The Event application for the Can-Am Festival was approved in a motion made by Deputy Mayor Boulton, seconded by Trustee Reilly. Vote 5 ayes (Battista, Boulton, Bray, Reilly and Frechette), 0 nays.

The application by Goodfello’s Restaurant for use of a piece of Village Property for outdoor seating was tabled for further consideration.

 

TRUSTEE REPORTS

Deputy Mayor Boulton reported that the Marketing Committee is progressing with the new Architectural Banner Project. The old banners will be on display at the Union Hotel for the summer season, after which they will be returned to their sponsors.

Deputy Mayor Boulton requested a motion to lift the open container law for the Can-Am Festival on 7-15-2017 from 12:00 pm to 9:30 pm on West Main St. from Broad St. to Ray St. including Market Square Park. The motion was made by Trustee Reilly, seconded by Trustee Frechette. Vote 4 ayes (Boulton, Bray, Reilly and Frechette), 1 nay (Battista).

 

Trustee Frechette reported that there was no activity on the Galloo Island Windfarm Article 10.

 

Trustee Bray reported that he had correspondence from resident Tom Dyckes with his recommendations for the tree committee.

 

Trustee Reilly reported that the Chamber of Commerce continues its membership drive. There will be a joint marketing committee meeting.

The Visitor’s Center will be hiring a part time worker this summer.

 

TREASURERS REPORT

The bills listed on Abstract 11 with vouchers #837 through #907 were paid in a motion made by Trustee Frechette and seconded by Trustee Reilly. Vote 5 ayes (Battista, Boulton, Bray, Reilly and Frechette), 0 nays.

The Treasurer’s written report was accepted in a motion made by Deputy Mayor Boulton and seconded by Trustee Bray. Vote 5 ayes (Battista, Boulton, Bray, Reilly and Frechette), 0 nays.

 

DEPARTMENT HEAD REPORTS

 

Gail Gorgen, Visitor’s Center, would like to advertise for summer help. This was approved in a motion made by Trustee Frechette and seconded by Mayor Battista. Vote 5 ayes (Battista, Boulton, Bray, Reilly and Frechette), 0 nays.

 

Kris Dimmick, Village Engineer, reported that the granite curbing is going in and we can expect people to complain that it is too high. It will appear lower when the paving is done. They have an optimistic schedule for completion.

He brought a handout listing the change orders, including drainage, and another budget sheet going over the snapshot of where we are today on the Main St. Project.

The Street Lighting project bids came in over budget; $99,000 was the low bid. After discussion, a

motion was made by Trustee Reilly and seconded by Mayor Battista to award the contract to Malone to install the infrastructure for the 8 lights while the ground is open, and includes change order #1 which will result in a $66,300.00 contract.

Mr. Dimmick also brought a map of sidewalk finish details. The walk on W. Main St. from Broad St. to Ray St. is 5 feet wide, the rest are 4 feet wide like the rest of the residential areas. He recommends a select granular base for the pavers to be done by Malone. The sidewalks in front of the Visitor’s Center are not included. He proposed a 10 foot wide paver sidewalk.

Dave Altieri, Heritage Area Director, proposed putting the Paver Project out to bid. Trustee Reilly recommended changing the width of the center approach to the sidewalk in front of the Visitor’s Center to 17 feet to match the width across the street from the park area. This was put out for bids in a motion made by Trustee Frechette and seconded by Trustee Reilly. Vote 5 ayes (Battista, Boulton, Bray, Reilly and Frechette), 0 nays.

 

Janet Quinn, Planning Board Chair, recommended that Attorney Dave Geurtson handle the next Madison Barracks PDD change for the Woodlark project. Dave Altieri has some suggestions for minor changes to the PDD update. He will be making his recommendations to the Board. Chair Quinn also noted that the building lots currently for sale at the Barracks never had final approval.

 

Office in Charge, Paul Trudeau, reported that Office John Poggi resigned. The Village is getting busier with the approach of the summer season. He expects parking to be an issue. The Postmaster will be posting no parking signs in the post office lot. Mayor Battista reported to Officer Trudeau that someone stole Andy Taylor’s ladder from Tin Pan Galley.

 

PUBLIC COMMENT

Merle Tousant, General Smith Dr, wanted confirmation that there will be grading and seeding on General Smith Dr. as part of the construction project.

Tim Scee reported that some of the businesses on W. Main St. had been approached by the contractor for the replacement of sidewalks that had been damaged during construction, at the expense of the individuals.

 

There is a Public Hearing scheduled at the School on a capital project replacing the roof, windows and boilers.

Local Law No. 2 of 2014 (The Village of Sackets Harbor Zoning and Subdivision Law of 2014) is hereby amended in part to amend Section 4-7 of Local Law No. 4 of the year 2001,incorporated therein by reference, providing for an update of the Madison Barracks Planned Development District, by adding the following sub-paragraph 4-7(B)(6) and amending 4-7(C) and (E) :

 

Section 4-7. Planned Development District-Madison Barracks.

The proposed lot lines and proposed roads on parcels B, Bl, C, M, Ml, N and X on the Plans are illustrative only.

 

E)                                                                                                                                     The following parcels and buildings require approvals under Subsection 4- 6 C and Article VIII, Site Plan Review, prior to the issuance on a zoning permit:

Section 3.    This Local Law is adopted pursuant to the Municipal Home Rule Law.   n accordance with Section 22 of the Municipal Home Rule Law, it is determined that any procedural or substantive provisions of this Local Law which are inconsistent with Local Law No. 1of the Year 2014, (the Village of Sackets Harbor Zoning and Subdivision Law of 2014),Section 4-7 of Local Law No. 4 of the  year 2001, or Village Law Sections 7-706, 7-708, 7-728 and 7-730, those inconsistent provisions are hereby superseded.

 

Section 4.    This Local Law shall take effect upon filing with the Secretary of State and as provided in Section 7-706 of the Village Law.
