Present: Mayor Vincent Battista, Deputy Mayor Barbara Boulton, Trustee Dan Frechette, Trustee Molly Reilly, Trustee James Bray. Also present: Jim Yuhas, Treasurer.

The Meeting was called to order at 6:30 pm with the Pledge of Allegiance.

 

REVIEW OF MINUTES

The Minutes from the July 11, 2017 meeting were approved as presented in a motion made by Trustee Reilly, seconded by Trustee Bray. Vote 5 ayes (Battista, Boulton, Frechette, Reilly and Bray), 0 nays.

 

A presentation was given by Don DiMonda from the LDC on the history of the LDC property. A Resolution to petition the Jefferson County Supreme Court to remove the restrictive covenants from the LDC property deed was passed with a motion made by Mayor Battista, seconded by Trustee Reilly. Vote 5 ayes (Battista, Boulton, Frechette, Reilly and Bray), 0 nays.

 

The meeting was opened to public comment at 7:05 pm.

John Deans spoke in support of the efforts of the LDC.

 

MAYORS REPORT AND CORRESPONDENCE

Mayor Battista reported on the LDC Board Meeting and gave the Fire Department’s report. He announced that tax assessment appeals have been filed by Woodlark and Liberty Sackets Harbor, LLC.

The September 12, 2017 meeting has been rescheduled for September 13th due to a conflict with the Primaries being held at the Village Hall.

A resolution to opt in to the NYS Lake Ontario and Connected Waterways Assessment Relief Act was approved in a motion made by Mayor Battista and seconded by Trustee Reilly. Vote 5 ayes (Battista, Boulton, Frechette, Reilly and Bray), 0 nays.

A change in pay for the Summer Rec Director was discussed. The topic was tabled until more information was received from the Summer Rec Committee.

 

PUBLIC COMMENT

The meeting was opened for Public Comment at 7:36 pm.

JP Constance, Hounsfield St, was concerned that people are putting stakes and sand bags in front of their houses to prevent visitors from parking in the Village owned right of way. Kris Dimmick, Village Engineer, had recommended allowing the stakes to stay to protect the new grass in the construction areas.

Eric Constance, W Washington St, reminded the board that the Rec Committee is a committee that answers to the Village Board. He is also concerned with the shortage of available parking in the Village.

Lonny Reinhardt reported that parking is an issue with every new business downtown. The last business added 7 cars to the public parking lot every day, not including their clients.

NEW BUSINESS

The Hay Memorial Library made a request for a Financial Review done by the Village Treasurer. He has agreed to do this. The Library also requested the use of the Village Hall for a fund raiser with Wilson Stevenson. They would like to use the kitchen for a canning class. These were approved in a motion made by Trustee Reilly and seconded by Trustee Bray. Vote 5 ayes (Battista, Boulton, Frechette, Reilly and Bray), 0 nays.

                                                              

A Vender Application was received from “2 Onions”, a food trailer business featuring Afghan, Indian and Mediterranean Foods. The application was tabled awaiting more information.

 

The Event Application was received from the Chamber of Commerce for Harvest Fest. It will be October 8, 2017 from 12 to 4 pm on West Main St. between the Visitor’s Center and the Band Stand. The application was approved by a motion made by Trustee Frechette, seconded by Deputy Mayor Boulton. Vote 4 ayes (Battista, Boulton, Frechette and Bray), 0 nays, 1 abstained (Reilly).

 

The Chamber of Commerce also submitted an Event Application for a jointly sponsored event with the PTO and the Hay Memorial Library. They would like to host “Sackets Under the Stars”, an outdoor movie on the Visitor’s Center Lawn on August 25, 2017. This will be an event to welcome students to the school year. The application was approved in a motion made by Trustee Frechette, seconded by Deputy Mayor Boulton. Vote 4 ayes (Battista, Boulton, Frechette and Bray), 0 nays, 1 abstained (Reilly).

 

TRUSTEE REPORTS

Deputy Mayor Boulton reported that the CanAm Festival was a big success this year. They have had an after-event meeting already. She also reported that so far there are 500 runners signed up for the 18.12 Challenge. They expect about 800 for the event.

Trustee Frechette extended his thanks to Don DiMonda, and the retiring Rob Oram for all the work that has gone into the LDC over the years.

Trustee Bray had nothing to report.

Trustee Reilly reported that businesses in the Chamber of Commerce are eager to learn more about the Lake Ontario and Connected Waterways Assessment Relief Act, as well as NYSESD assistance available due to the flooding. The Chamber Marketing Committee meeting is planned for August 29th.

She also reported that Wi-Fi connectivity remains an issue at the Visitor Center.

 

TREASURER’S REPORT

The Treasurer’s Report was accepted in a motion made by Trustee Frechette, seconded by Trustee Reilly. Vote 5 ayes (Battista, Boulton, Frechette, Reilly and Bray), 0 nays.

The bills were paid in the Record of Claims, with vouchers 100164 through 100271 in a motion made by Deputy Mayor Boulton, seconded by Trustee Bray. Vote 5 ayes (Battista, Boulton, Frechette, Reilly and Bray), 0 nays.

DEPARTMENT HEAD REPORTS

Lonny Reinhardt, DPW Superintendent, reported that Homeland Security has been here twice, the last time with FEMA, to assess the damage done to Village Property from the flooding. It is currently estimated at $650,000. He also reported that the bids were received for the paving on Ambrose St. and the Water Plant. He recommends hiring Cornerstone Paving at a cost of $118,550.00. This was authorized in a motion made by Trustee Reilly and seconded by Trustee Frechette. Vote 5 ayes (Battista, Boulton, Frechette, Reilly and Bray), 0 nays. The company hired to do the repairs to the Village Clock, Verdin Co. was here to do some preliminary work and will be back in October or November.

Kris Dimmick, Village Engineer, reported that the final walk through was done on the Main St. Project to determine the final punch list. The water storage tank painting project bid opening was this afternoon. One bid was considerably lower than the others. He will be checking references and proceed from there. Depending on the results of that, the Board authorized the Mayor to sign the contracts when ready in a motion made by Trustee Reilly, seconded by Trustee Bray. Vote 5 ayes (Battista, Boulton, Frechette, Reilly and Bray), 0 nays.

Janet Quinn, Planning Board Chair, reminded the Village Board that they still need another member appointed to the Planning Board. She is coordinating with David Altieri to update the application materials to make it clear to applicants that they are responsible for Village expenses incurred by their application.

Paul Trudeau, Police OIC, reported that there have been 2 recent accidents with vehicle 366 and he would like to repair the bumper but not replace the brush guard. That vehicle is scheduled to be replaced next year.

Dave Altieri, Heritage Area Director, reported that Pickering Beach Museum is doing well under Kelli Ritz this year.

Village of Sackets Harbor Board of Trustees Resolution

 

                        WHEREAS, that the Village Board of Trustees are in receipt of the Certification of Completion from the New York State Department of Environmental Conservation dated March 30, 2017, for the properties owned by the Village of Sackets Harbor located at 303 Ambrose Street referred to as tax map no.: 88.35-1-4.1 and 314 Ambrose Street referred to as tax map no.: 88.35-1-4.31 received

            WHEREAS, that the Village Board of Trustees now desire to take action in regards to allowing for future use and development of the properties for the benefit of the Village of Sackets Harbor.

WHEREAS, that the Village Board of Trustees acknowledges that there are Restrictive Covenants and a License and Use Agreement that will inhibit using the property for future use and development for the benefit of the Village of Sackets Harbor.  

RESOLVED, the Village Board of Trustees authorize Conboy, McKay, Bachman & Kendall, LLP to bring an action on behalf of the Village of Sackets Harbor and the co-owner of the property, Sackets Harbor Local Development Corporation pursuant to Article 15 of the Real Property Action and Proceedings Law, referred to as an Action for Quiet Title, in Jefferson County Supreme Court to remove the Restrictive Covenants and License and Use Agreement from title to the aforesaid properties.

Resolution:

 

Be it resolved that the Village Board of Trustees authorizes opting in to the NYS Lake Ontario and Connected Waterways Assessment Relief Act, offering relief to those whose buildings and other property improvements have been damaged by the flooding that occurred between April 1, 2017 and July 1, 2017. We authorize offering relief to those who lost less than 50% of their value or those who lost 50% or more of their value.
