MINUTES
July 5, 2006
I. Call to Order
Chairman Cring called the meeting to order at 7:15p.m.
II. Establishment of Quorum
Members present: Harold Cring, Paul Warneck, Mary Jo Deans, Steven McPherson, and G. Hale Smith
Members absent: Janet Quinn and Eric Constance
III. Approval of Minutes:
A motion was made by Paul Warneck, seconded by Mary Jo Deans to adopt the Minutes of May 3, 2006. Vote carried 5-0
A motion was made by Paul Warneck, seconded by Steven McPherson to adopt the Minutes of June 7, 2006. Vote carried 5-0
IV. Old Business
A. 06-10 Erica Fiola, 113 Bayview Place, Madison Barracks, proposes changes to the previously approved site plan, color changes and a new fence. Project requires review under the Zoning Laws of the Village of Sackets Harbor and Historic District Guidelines and the terms of the PDD. The project was advertised and a Public Hearing was held. Color change and fence was approved, driveway changes were not. A letter was sent to the applicant by James Corbin requesting that only one driveway be installed and an application needs to be made to the Planning Board for the second to be installed on the Brady Road side of the parcel.
The applicant had the driveway paved irregardless of the Planning Boards concerns. Zoning Officer James Corbin to send a letter to the Village Board with a laundry list of concerns that need to be addressed.
B. 06-20 Robert & Brenda Schultes, 212 N Broad St, proposes the removal of an existing shed and replacing with a new shed, remove and replace a pool and build a wood deck. Project requires review under the Zoning Laws of the Village of Sackets Harbor and Historic District Guidelines. The project was advertised and a Public Hearing was held.
ZBA approved variance; the application is approved with the 19’6” rear yard setback.
V. New Business
A. 06-28 John & Mary Jo Deans, 104 W. Main Street, Sackets Harbor. Applicant proposes to replace concrete steps with wooden ones. Project requires review under the Zoning Laws of the Village of Sackets Harbor and Historic District Guidelines. The project was advertised and a Public Hearing is scheduled to be held.
Mrs. Deans recused herself from review of this application.
A motion was made by Steven McPherson, seconded by Paul Warneck to acknowledge receipt of the application. Vote carried 4-0
The Public Hearing was opened at 7:29 p.m.
After hearing no comments, a motion was made by Steven McPherson, seconded by Paul Warneck to close the Public Hearing. Vote carried 4-0
Mrs. Deans said that the steps will be white risers with brown tread.
A motion was made by Paul Warneck, seconded by Steven McPherson to declare this action a Type 1 action under SEQR, to dispense with the reading of the EAF, to declare the Planning Board Lead Agency, and to issue a negative declaration in regards to SEQR. Vote carried 4-0
A motion was made by Stephen McPherson seconded, by G. Hale Smith to accept the application as complete. Vote carried 4-0
A motion was made by Steven McPherson, seconded by G. Hale Smith to approve the application. Vote carried 4-0
B. 05-16 Revision B, 18 Mercedes Lane, Harbor Haven. Dave Leger, proposes revisions to construct a 24’ x 36’ garage. Project requires review under Site Plan Review criteria and the Subdivision Control Law and the terms of the PDD. The project was advertised and a Public Hearing is scheduled to be held.
A motion was made by Steven McPherson, seconded by Paul Warneck to acknowledge receipt of the application. Vote carried 5-0
Mr. McPherson noted that there were not any catalog cuts for the garage doors and the roof pitch was not indicated on the plans. Mr. Warneck stated that together the size of the garage and the paving come close to the limit of impervious surface. Chairman Cring noted that the setbacks have changed on each and every application, Mr. Leger has shifted all the homes to the opposite side of the lots, and the elevations are missing. Mr. Warneck requested that the applicant submit a revised C1 drawing.
C. 05-21 Revision C, 23 Mercedes Lane, Harbor Haven. Dave Leger, proposes revisions to construct a 24’ x 24’ garage. Project requires review under Site Plan Review criteria and the Subdivision Control Law and the terms of the PDD. The project was advertised and a Public Hearing is scheduled to be held.
Chairman Cring noted that the drawings are missing the elevations of the buildings and the garage has been moved to the rear of the lot. Mr. McPherson suggested a letter from the applicant rescinding all prior revisions to the applications so that only one application/approval was on the official record.

VII. Adjournment
The next Regular Planning Board Meeting is scheduled for July 5, 2006 at 7:00 p.m. in the Municipal Building. There being no additional business, a motion was made by Paul Warneck, and seconded by Steve McPherson to adjourn the meeting at 9:02p.m. Vote carried 7-0
