MINUTES

August 2, 2006


I.               Call to Order

Chairman Cring called the meeting to order at 7:07p.m.


II.        Establishment of Quorum

            Members present: Harold Cring, Paul Warneck, Janet Quinn, Steven McPherson, and G. Hale Smith

            Members absent: Mary Jo Deans and Eric Constance


III.       Approval of Minutes:

A motion was made by Paul Warneck, seconded by G. Hale Smith to adopt the Minutes of July 5, 2006.  Vote carried 5-0


IV.           Old Business


A.    06-10   Erica Fiola, 113 Bayview Place, Madison Barracks, proposes changes to the previously approved site plan, color changes and a new fence.  Project requires review under the Zoning Laws of the Village of Sackets Harbor and Historic District Guidelines and the terms of the PDD. The project was advertised and a Public Hearing was held. Color change and fence was approved, driveway changes were not.  A letter was sent to the applicant by James Corbin requesting that only one driveway be installed and an application needs to be made to the Planning Board for the second to be installed on the Brady Road side of the parcel.


The applicant had the driveway paved irregardless of the Planning Boards concerns.  Zoning Officer James Corbin is addressing the issue of two driveways.  Mr. Corbin has issued Stop Work Orders to the all owners in question and has been in contact with two out of the three property owners.


        B.    05-21   Revision C, 23 Mercedes Lane, Harbor Haven. Dave Leger, proposes revisions to construct a 24’ x 24’ garage. Project requires review under Site Plan Review criteria and the Subdivision Control Law and the terms of the PDD.  The Public Hearing was not held.  Application was deemed incomplete.

                Nothing new at this time.

        C.    05-18   Revision B, 20 Mercedes Lane, Harbor Haven. Dave Leger, proposes revisions to construct a 24’ x 36’ garage. Project requires review under Site Plan Review criteria and the Subdivision Control Law and the terms of the PDD.  The Public Hearing was not held.  Application was deemed incomplete.  Applications also require an amendment to the PDD as setbacks were changed.

        Nothing new at this time.


                V.    New Business

       

        A.    04-34   Revision A, Susan Roach, 206 E. Main St. proposes revisions to the minor subdivision previously submitted. Project requires review under the Zoning Laws of the Village of Sackets Harbor and the Subdivision Control Law. The project was advertised and a Public Hearing is scheduled to be held

                New drawings received.  Attorney Dianna Nelson stated that the lot lines would be moved to allow 2.5 acres for a final lot size for lot one. 

A motion was made by Paul Warneck, seconded by Steven McPherson to acknowledge receipt of the application.  Vote carried 5-0

The Public Hearing was opened at 7:19 p.m.

After hearing no comments a motion was made at 7:20 p.m. by Paul Warneck, seconded by Janet Quinn to close the Public Hearing.  Vote carried 5-0


A motion was made by Paul Warneck, seconded by Janet Quinn to declare this action a Type 1 action under SEQR, to dispense with the reading of the EAF, to declare the Planning Board Lead Agency, and to issue a negative declaration in regards to SEQR.  Vote carried 5-0


A motion was made by Paul Warneck, seconded by Janet Quinn to accept the application as complete with the following contingencies: utility easements are to be defined on the drawings; the boundary of the Village lot to be defined on the drawings; there is to be a 66’ dimension for the extension of Washington Street; and lot one is to maintain a 2.5 acre final lot size.  Vote carried 5-0


A motion was made by Steven McPherson, seconded by Paul Warneck to approve the application with the aforementioned contingencies.  Vote carried 5-0


        B.    06-38   JP & Karen Constance, 107 Hounsfield St., proposes a minor subdivision of their property located at 203-205 Woolsey St.  Project requires review under the Zoning Laws of the Village of Sackets Harbor and the Subdivision Control Law. The project was advertised and a Public Hearing is scheduled to be held

       

A motion was made by Paul Warneck, seconded by Steven McPherson to acknowledge receipt of the application.  Vote carried 5-0

                Chairman Cring noted that the application had gone to ZBA but had been withdrawn to go before the Planning Board first.  ZBA Chairman Rob Oram stated that the application requires at least a side yard zero lot line and front yard variance.  Mr. Warneck inquired as to who would perform the maintenance of the properties and where the utilities are located on the property.  Mr. McPherson asked if the current common wall meets fire codes.  Mr. McPherson also asked what would prevent the owners to maintain each side with a different color scheme or even shingles.  Applicant is to provide a maintenance agreement and utilities to be marked on the drawings.  Attorney Mark Gebo stated that the only changes that are to be made will be on paper to divide ownership of the building and that deed agreements will be supplied.

The Public Hearing will be opened at 7:38 p.m.

After hearing no comment a motion was made at 7:39 p.m. by Steven McPherson, seconded by Paul Warneck to close the Public Hearing.  Vote carried 5-0

                                                                                                                                                               

                Mr. Warneck stated and Mr. McPherson agreed that the process should be done correctly.  Chairman Cring said that the Zoning Laws are out of date and that duplexes if done correctly should be allowed in the village.  Mrs. Quinn asked what the sizes of the lots would be.  Mr. Constance said that one would be 12,500 sq ft and the other would be 17,000 sq ft. 

A motion was made by Paul Warneck, seconded by Steven McPherson to declare this action a Type 1 action under SEQR, to dispense with the reading of the EAF, to declare the Planning Board Lead Agency, and to issue a negative declaration in regards to SEQR.  Vote carried 5-0


A motion was made by Paul Warneck, seconded by Steven McPherson to table the application pending submission of requested documents.  Vote carried 5-0


        C.    06-36   Donna Peck, Natural Bridge, NY, proposes a minor subdivision of their property located at 214 Monroe St. Project requires review under the Zoning Laws of the Village of Sackets Harbor and the Subdivision Control Law. The project was advertised and a Public Hearing is scheduled to be held

A motion was made by Paul Warneck, seconded by Janet Quinn to acknowledge receipt on the application.  Vote carried 5-0

                Chairman Cring noted that a phone call was made to the applicant requesting that existing utilities be marked on the drawings.

The Public Hearing was opened at 8:04 p.m.

                Mr. Russell asked for an explanation of the letter.  Mr. Warneck explained that the engineer needs to produce drawing depicting infrastructure to the lots that are to be sub-divided.  It is the belief of the Planning Board after being notified by DPW Superintendent Lonny Reinhardt that the infrastructure may not reach lot #3. 

A motion was made at 8:21 p.m. by Paul Warneck, seconded by Steven McPherson to close the Public Hearing.  Vote carried 5-0

A motion was made by Paul Warneck, seconded by Steven McPherson to declare this action a Type 1 action under SEQR, to dispense with the reading of the EAF, to declare the Planning Board Lead Agency, and to issue a negative declaration in regards to SEQR.  Vote carried 5-0


A motion was made by Paul Warneck, seconded by Janet Quinn to accept the application as complete upon submission of adequate documentation of infrastructure being available to all lots being sub-divided.  Vote carried 5-0


A motion was made by Paul Warneck, seconded by G. Hale Smith to approve that application pending submission of the aforementioned documentation.  Vote carried 5-0


        D.    06-35   Robert Oram, 364 Dodge Ave, proposes a minor subdivision of their property. Project requires review under the Zoning Laws of the Village of Sackets Harbor and the Subdivision Control Law. The project was advertised and a Public Hearing is scheduled to be held

A motion was made by Paul Warneck, seconded by Janet Quinn to acknowledge receipt of the application.  Vote carried 5-0

The Public Hearing was opened at 8:25 p.m.

After hearing no comment a motion was made at 8:26 p.m. by Steven McPherson, seconded by Paul Warneck to close the Public Hearing.  Vote carried 5-0


                Chairman Cring noted that a stamped drawing needs to be submitted.


A motion was made by Paul Warneck, seconded by Janet Quinn declaring this an Unlisted Action.  Vote carried 5-0


A motion was made by Steven McPherson, seconded by Paul Warneck accepting the application as complete with the submission of stamped drawings and a Mylar.  Vote carried 5-0


A motion was made by Paul Warneck, seconded by Steven McPherson to approve the application with the submission of the aforementioned drawings.  Vote carried 5-0


        E.     06-37   Julie Hess, 112 Bayview Place, Madison Barracks, proposes exterior color change to the siding and trim. Project requires review under the Zoning Laws of the Village of Sackets Harbor and Historic District Guidelines and the terms of the PDD. The project was advertised and a Public Hearing is scheduled to be held


A motion was made by Steven McPherson, seconded by Paul Warneck to acknowledge receipt of the application.  Vote carried 5-0

The Public Hearing was opened at 8:25 p.m.

After hearing no comments a motion was made at 8:26 p.m. by Steven McPherson, seconded by Paul Warneck to close the Public Hearing.  Vote carried 5-0

                Paul Warneck noted that Julie Hess is not the owner of record. 

A motion was made by Paul Warneck, seconded by Janet Quinn to table the application pending clarification of ownership and pending zoning infractions.  Vote carried 5-0

Pre-Submission Conference;


A letter was received from GYMO stating that Phillip J Simao from Liberty Sackets Harbor, 205 General Smith Drive, would like to add windows on the street side of his building to match those on the rear side.  Mr. McPherson and Mr. Warneck said they would like to see a conceptual drawing.


Seaway Homes, LLC requested a pre-submission conference in regards to a major sub-division of the land purchased from the Town behind the 3rd Alarm Building. 


                VII.  Adjournment

The next Regular Planning Board Meeting is scheduled for September 6, 2006 at 7:00 p.m. in the Municipal Building.  There being no additional business, a motion was made by Paul Warneck, and seconded by G. Hale Smith to adjourn the meeting at 9:09p.m.  Vote carried 5-0
