December 6, 2006



I.               Call to Order

Vice Chairman Warneck called the meeting to order at 7:02p.m.


II.        Establishment of Quorum

            Members present: Harold Cring, Paul Warneck, Janet Quinn, Mary Jo Deans, G. Hale Smith, and Eric Constance

            Members absent: Steven McPherson


III.       Approval of Minutes:

A motion was made by Paul Warneck, seconded by Janet Quinn to adopt the Minutes of October 11, 2006.  Vote carried 6-0


IV.          Old Business

A.    06-47   Stephen Crandall, 103 East Main Street, proposes construction of a deck, skylights and a privacy fence.  Project requires review under the Zoning Laws of the Village of Sackets Harbor and Historic District Guidelines. The project was advertised and a public hearing is scheduled to be held.

                        Nothing new at this time.

        B.    06-51   Battlefield Commons, LLC, Hill, Ray, Bayard & Edmund Streets, proposes a 19 lot subdivision. Project requires review under the Subdivision Control Law.  The project was advertised and a public hearing is scheduled to be held. Drawings are being revised per Village Engineer comments. PB has been granted lead agency status by all involved agencies.

               

                Engineering reports were received.

        C.    06-54   Erica Fiola, 113 Bayview Place, proposes a window, driveway and landscaping.  Project requires review under the Zoning Laws of the Village of Sackets Harbor and Historic District Guidelines. The project was advertised and a public hearing is scheduled to be held

A motion was made by Mary Jo Deans, seconded by Eric Constance to remove the application from tabled status.  Vote carried 6-0

                A presentation was given by Mr. Robert Sharon for applications #06-54, #06-57, & #06-60 for a complementary landscaping plan.  A landscaping plan was discussed that would treat all three parcels as one unit; a plan to disguise the pavement with the trees not to be tall enough to block the view from the front of the houses.

A motion was made by Paul Warneck, seconded by Mary Jo Deans to proceed with the idea of a landscaping plan as the solution for the pavement issue.  Vote carried 6-0


Mr. Warneck asked for a simplified drawing of all three properties together.  Mr. Sharon, Mr. and Mrs. William Stoodley (representing the Whites) and Miss Hess took the time to come up with a drawing and present it to the Board.  After reviewing the drawing, it was decided that the applicants would update the drawing and bring it back to the next meeting of the Planning Board.


A motion was made by Paul Warneck, seconded by Mary Jo Deans to table the application pending submission of an updated drawing.  Vote carried 6-0

V.    New Business

                A.    06-57   Julie Hess, 112 Bayview Place, proposes a driveway and landscaping.  Project requires review under the Zoning Laws of the Village of Sackets Harbor and Historic District Guidelines.

A motion was made by Paul Warneck, seconded by Eric Constance to acknowledge the application.  Vote carried 6-0

The Public Hearing was opened at 8:16 p.m.

After hearing no comments a motion was made by Eric Constance, seconded by Mary Jo Deans at 8:17 p.m. to close the Public Hearing.  Vote carried 6-0


A motion was made by Paul Warneck, seconded by Eric Constance to declare this action a Type 1 action under SEQR, to dispense with the reading of the EAF, to declare the Planning Board Lead Agency, and to issue a negative declaration in regards to SEQR.  Vote carried 6-0


A motion was made by Paul Warneck, seconded by Eric Constance to table the application pending submission of an updated drawing.  Vote carried 6-0

        B.    06-60   Leroy and Ester White, 114 Bayview Place, proposes a driveway and landscaping.  Project requires review under the Zoning Laws of the Village of Sackets Harbor and Historic District Guidelines.

A motion was made by Paul Warneck, seconded by Eric Constance to acknowledge the application.  Vote carried 6-0

The Public Hearing was opened at 8:19 p.m.

After hearing no comments a motion was made by Eric Constance, seconded by Paul Warneck at 8:20 p.m. to close the Public Hearing.  Vote carried 6-0

                VII.     Adjournment

The next Regular Planning Board Meeting is scheduled for January 3, 2006 at 7:00 p.m. in the Municipal Building.  There being no additional business, a motion was made by Eric Constance, seconded by Janet Quinn to adjourn the meeting at 8:20p.m.  Vote carried 6-0
