MEETING MINUTES
Wednesday, March 19, 2008
Meeting called to order at 7:00 PM by Janet Quinn, sitting in as Chair for Paul Warneck. Present: Janet Quinn, Gary Gibson, Hale Smith, Mark Crandall, Steve Swain, and Kevin Elliott. Absent: Paul Warneck, quorum established.
Review Minutes of February 20, 2008 Planning Board Minutes. Motion made by Hale Smith to accept minutes as printed, seconded by Steve Swain, motion carried 6-0.
Janet Quinn reported that the Village Board needs to appoint a new Planning Board chair due to the resignation of Paul Warneck, and also two new Board members and to think about anyone they know would be interested in these positions and the Planning Board will discuss it at the end of this meeting.
Old Business:
Presentation: Liberty Sackets Harbor As-Built drawings were presented by Ed Olley of GYMO for the property on General Smith Drive. There was discussion on the legends noted on the site plan drawing. Not all legends were detailed; Ed Olley agreed to attach a revised legend to the plan to describe all the features shown. Mark Crandall questioned the lack of the deed restrictions and the other details which Olley agreed to provide. Gary Gibson suggested amending the as-builts with all legends titled and refile a new site plan with deed restrictions attached. A motion was introduced by Mark Crandall to deem the as-builts incomplete and asked for further details, as stated; seconded by Gary Gibson, carried 6-0.
Alice Holman - Minor Subdivision. Applicant proposes subdividing tax map parcel 88.27-1-4 at 501 W. Washington St. Application requires review under the Village of Sackets Harbor Subdivision Law as well as the NYS SEQR Act. A public hearing was held on 1/2/08. Applicant has submitted revised plans pursuant to the ZBA approval. A public hearing has been scheduled.
Motion introduced by Gary Gibson to acknowledge receipt of the application with the
required ZBA contingencies. Motion seconded by Mark Crandall and carried 6-0. The
required survey has been completed and plans stamped from the modular dealer. Motion to
open the public hearing at 7:20 PM was made by Steve Swain, seconded by Gary Gibson and
carried 6-0.
Eric Constance, 112 West Washington Street, asked if there was a copy of the applicant's
drawing for the public to view. A copy was put out for public display.
Harold Cring, 108 Hounsfield Street, asked if the applicant was considering hooking their
sewer into his development at Battlefield Commons. Applicant stated that are going to have
a lift station going down Hill Street to Washington Street.
Dave Altieri, Heritage Area Director, stated he is against the sub-division as the property is
adjacent to a State historic site and the construction would interfere with the integrity of the
State historic site and there is a possibility that this is an archeological hot spot with the site
being located on a major cantonment area.
Applicant spoke to the Director of the State Parks and he stated he has no problem with
the sub-division of their property.
Public hearing was closed at 7:30 PM in a motion made by Mark Crandall and seconded
by Steve Swain, carried 6-0.
Discussion followed regarding the historical significance of the area. Gary Gibson reported that he has spoken to Tim Abel of the Jefferson County Historical Society and he feels there is significant historical artifacts in the area. The applicant was informed of what an archeological dig involves, and that there has not been a study done of the area.
Janet Quinn stated that since the project is within 500' of a State Park that they should be
given a chance to review the SEQR and Jefferson County Planning Department should
also be contacted for input. Applicant asked how long it would delay their project and
was told that the Board would try to expedite it as fast as possible.
A motion to declare the application complete with the contingencies made by the ZBA
was made by Steve Swain, seconded by Gary Gibson, carried 6-0. Motion to declare the
Planning Board as lead agent and to declare this a Type I action was made by Janet
Quinn, seconded by Gary Gibson and carried 6-0.
Janet Quinn stated that she has questions with the question on page 16 of the SEQR form
and with a section on page 19 regarding the impact on the character of the neighborhood.
This is something that perhaps the State Parks and the Jefferson County Planning should
consider.
Motion to table this application until we hear back from the three agencies involved: the NY
State Historic Preservation Office (SHPO), the 1000 Islands Region of the NYSOPRHP, and
the Jefferson County Department of Planning; was made by Steve Swain, seconded by Gary
Gibson, carried 6-0. The two agencies have 30 days to respond.
Robert & Mary Johnson - 311 W. Main St. For addition to existing home in the Historic District. Project requires review under the guidelines of the Village of Sackets Harbor Zoning Ordinance and Historic Overlay District. A public hearing has been scheduled.
Mr. Johnson submitted his plans at the last board meeting for a pre-submission review, at that time the Board asked Mr. Johnson to submit detailed architectural drawings on materials.
Motion to acknowledge receipt of the application was made by Gary Gibson and seconded by
Steve Swain, carried 6-0. Motion to open the public hearing at 8:01 PM was made by Steve Swain and seconded by Gary Gibson, carried 6-0. Motion to close the public hearing at 8:07 PM was made by Gary Gibson, seconded by Steve Swain, carried 6-0.
Motion to accept the application as complete with the required architectural details asked for at the last meeting was made by Kevin Elliott and seconded by Steve Swain, motion carried 6-0.
Motion to dispense with the reading of the SEQR form and declare this a Type 2 application,
and to issue a Negative Declaration was made by Mark Crandall, seconded by Kevin
Elliott, motion carried 6-0.
Motion to approve the site plan as submitted with the detailed materials asked for was
made by Gary Gibson, seconded by Hale Smith and carried 6-0. Application approved.
Merlin Tousant - 301 General Smith Dr. For addition to existing home in the Historic District. Project requires review under the guidelines of the Village of Sackets Harbor Zoning Ordinance and Historic Overlay District. A public hearing has been scheduled.
Motion to acknowledge receipt of the application was made by Steve Swain, seconded by Gary Gibson, carried 5-0.
Daniel Manning, agent for the applicant, presented the architectural drawing for the project, showing roofing, siding and window placement. Applicant would like to widen the existing garage 4' to make room for two vehicles; is adding an 8' addition on back of house, and filling in existing front porch to extend interior of residence.
Motion to open the public hearing was made by Janet Quinn at 8:22 PM, seconded by Steve Swain and carried 6-0. Hearing no comments from the public, motion made by Mark Crandall to close the public hearing at 8:23 PM, seconded by Gary Gibson, carried 6-0.
The Board asked the agent to provide details of materials to be used. Motion to deem the application complete contingent on agent supplying the material details was made by Steve Swain, seconded by Gary Gibson, carried 6-0. Zoning Enforcement Officer will complete the check list for LWRP and submit it to attach to the application. Motion to deem this a type 2 application, and issue a negative declaration and to dispense with the reading of the EAF was made by Gary Gibson, seconded by Steve Swain, carried 6-0.
Motion made by Gary Gibson to grant site plan approval pending receipt of architectural material details of shingles, siding, windows, shutters, lights, etc.; seconded by Steve Swain, carried 6-0. Application approved.
Liberty Sackets Harbor - 207 General Smith Drive for a site plan review to: 1. Construct shoreline docks; and 2. Install a wave attenuator. Project requires review under the guidelines of the Village of Sackets Harbor Zoning Ordinance and Historic Overlay District. Terms of the Harbor Management Law requires review. A public hearing has been scheduled Kevin Elliott recused himself from the remaining projects as he is employed with the architect.
Motion made by Gary Gibson to acknowledge receipt of the applications, seconded by Janet Quinn, carried 5-0. Applicant submitted one application for two projects.
Hunter Grimes, agent for the applicant, discussed the wave attenuator and how it operates and the placement of it in the harbor.
Motion made by Mark Crandall to acknowledge receipt of the application, seconded by Gary Gibson, carried 5-0. Motion to open public hearing at 8:44 PM was made by Gary Gibson, seconded by Steve Swain, carried 5-0. Butch Coseo, Harbormaster for the Village, reported that the application places the proposed wave attenuator within the harbor's Vessel Regulation Zone and that Section 3-3D of the Village's Waterfront Management Law (Local Law #4, 1990) states that no person shall place any structure within the Vessel Regulation Zone. Mr. Grimes reported that the wave attenuator would be placed 30' beyond the existing dock, thereby putting it in the navigation zone.
Floyd Dame, 413 West Main Street is concerned with safety issues with the boats moored at Navy Point Marina and other vessels entering the harbor. Ed Olley, Jr., agent for the applicant, stated that a permit was issued in 1984 to the previous owner allowing him to construct the docks 150', the dock was built to 110'. Mark Crandall suggested they use a smaller wave attenuator and placing it closer to Navy Point.
Motion made by Steve Swain to close the public hearing at 8:55 PM, seconded by Gary Gibson, carried 5-0.
Gary Gibson said that with what Harbormaster Coseo pointed out about the Navigation Law, if the Board was to approve this application, they would be in violation of the Waterfront Management Law. Mark Crandall suggested putting the wave attenuator underneath the dock. Mr. Grimes said this could be done but would not be as successful in attenuating the waves as it would be if placed outside the dock area. Motion to disapprove the part of this application pertaining to the proposed installation of a wave attenuator based on this part of the application being in violation of Section 3-3D of the Village's Watertown Front Management Law was made by Mark Crandall, seconded by Gary Gibson, carried 5-0. Application is disapproved.
In regards to the part of the application requesting construction of shore-line docks, applicant has Army Corps of Engineers approval to construct docks. The Board tabled the application until the applicant or his agent furnishes the board with the detailed drawings showing materials to be used.
The agent for the applicant submitted a pre-submission architectural drawing of a concrete wall to be placed on the side of the property on General Smith Drive. The wall started at 2' and grades up to approximately 7', with the top of the wall to be level. The applicant will submit a new application for the concrete screen wall and was informed the he would require ZBA approval with the wall heights as presented.
Harold Cring - The Boathouse Restaurant. Site Plan review for alterations to the foundation and enlarging a deck. Project requires review under the guidelines of the Village of Sackets Harbor Zoning Ordinance and Historic Overlay District. Terms of the Harbor Management Law may be applicable. A public hearing has been scheduled.
Motion to acknowledge receipt of the application was made by Gary Gibson, seconded by Hale Smith, carried 5-0. Ed Olley, Jr., agent for the applicant distributed the full EAF and photos of the existing structure showing the foundation. The applicant would like to reconstruct, enlarge, and stabilize the existing deck.
Motion to open the public hearing was made by Gary Gibson, seconded by Mark Crandall, carried 5-0.
Officer Coseo, Harbormaster for the Village reviewed the application and has no problems with the Village's Waterfront Management Law and vessel traffic issues. Motion to close the public hearing was made by Mark Crandall, seconded by Gary Gibson and carried 5-0.
Mark Crandall said the applicant needs to list on the site plan the color of the deck and light poles and to show manufacturer's catalog cuts of products they will be using.
Motion to deem the application complete, with the condition that the decking design be parallel or perpendicular and the color of the deck is to be earth tone grey, made by Gary Gibson, seconded by Mark Crandall, carried 5-0. ZEO Jim Corbin reviewed the LWRP and found no items of concern. Motion to dispense with the reading of the EAF and declare this a Type 1 Action under SEQR, issue a negative dec, and to declare the Village as lead agency was made by Gary Gibson, seconded by Steve Swain, carried 5-0.
Motion to approve the application complete with the condition that the applicant is granted approval from the Army Corps of Engineers was made by Steve Swain, seconded by Mark Crandall, carried 5-0. Application approved.

Motion to open the public hearing opened at 9:59 PM was made by Mark Crandall,
seconded by Steve Swain, carried 5-0. Hearing no comments from the public, hearing
closed at 10:00 PM.
Motion to grant preliminary approval of the application, contingent on the Board receiving catalogue cuts of products to be used was made by Gary Gibson, seconded by Janet Quinn, carried 5-0. Application approved.
OTHER BUSINESS
The Board discussed recommending to the Village Board to keep the Planning Board as a 7
member board.
