Meeting was called to order at 5:35 PM by Chairman Jon Constance. Members present: Jon Constance, Floyd Dame, John Kenna, Larry Barone and Molly Reilly.

Minutes of the July 21, 2015 meeting were approved as corrected in a motion made by Larry Barone and seconded by Jon Constance.  (Vote 5 Ayes, 0 Nays)

NEW BUSINESS:

·         #14-36 Ronald D Miller, applicant is requesting a rear yard variance for an 8 x 12 lean-to. A public hearing has been advertised and is scheduled for this meeting.

A suggestion to open the public hearing at 5:40 PM was made by Jon Constance, with the observation that there was no one present in the audience to make a comment. The public hearing was closed by a motion made by Floyd Dame and seconded by Larry Barone (Vote 5 Ayes, 0 Nays) and the regular session resumed.

Jon Constance noted that the lean to in question has already been built and the owner has been informed that it does not meet the set-back requirements by the Zoning Enforcement Officer. The other two buildings (a garage and a shed) are also non-conforming but pre-date the zoning law. Larry Barone brought a Google Map picture of the lot done prior to the lean-to construction, showing this.

Jon Constance said he does not see the need for the lean-to. Floyd Dame stated that it is up to the applicant or his agent, to be here to state his case.

Jon Constance read from the Village of Sackets Harbor Zoning Law Article VI, 6-1, B, that “Non-conforming buildings or other structures shall not be enlarged, extended or structurally altered, except where the enlargement or extension does not increase the nonconformity.”

A motion to deny the variance request of the application was made by Jon Constance and seconded by Molly Reilly. (Vote 5 Ayes, 0 Nays)

Motion to close the meeting was made at 5:57 PM by Larry Barone and seconded by Molly Reilly. (Vote 5 Ayes, 0 Nays)
