The
meeting was called to order at 4:30 PM by Chairman Jon Constance. Members
present: Jon Constance, Molly Reilly, John Kenna, Larry Barone, Floyd Dame.
NEW
BUSINESS:
A
public hearing was opened at 4:31 pm to hear comments regarding #15-58Z Daniel St. Hilaire, 122 Boultons
Beach Rd, Sackets Harbor - The applicant would like to install a 12’ x 24’
storage shed. He is requesting a side set-back variance.
Chairman
Constance brought it to the meetings attention that an accessory structure of
120 square feet requires no set back variance if it is 7.5’ off the side
property line. A 12’ x 24’ structure needs a variance unless it is 15’ off the
side property line.
Mr.
St. Hilaire would like to move it to 7’ from the side property line for both
aesthetic and functional reasons.
John
Kenna and Floyd Dame wanted to know why he wanted it placed that way, as an
alternative would be to turn it 90º. As proposed, the door would open facing
the neighbor’s property and he would have to drive on their property with his
tractor. Mr. St. Hilaire said he had his neighbors’ permission to drive on
their property.
The
public hearing was closed at 5:00 pm by a motion by Floyd Dame and seconded by
Larry Barone. (5 ayes, 0 nays)
The
scheduled public hearing was opened at 5:00 pm for application #15-56Z Justin Wood, 107 Ambrose St,
Sackets Harbor - The applicant would like to confirm permission to use the existing
garage apartment as a residence prior to purchasing the property. He is
requesting an area variance of the minimum lot size for an accessory apartment
from the required 10,000 square feet to the existing 8,973 square feet.
Chairman
Constance read a letter from a neighbor, Donna Jean McAndrews, owner of 106 W.
Washington St. in support of the application.
Ed
Tillson, 108 Ambrose St, Sackets Harbor, spoke of his concerns regarding the
application. He believes there would be tenant issues. With potentially 3
families living there, it would be overloaded with cars and belongings. If
everyone had 2 cars, there would be six cars. The yard is small and he believes
it would negatively impact the neighborhood.
The
applicant confirmed that the lot is 110’ wide and 81’ deep along Barn Alley.
There
are currently 3 sewer accounts and 2 water meters for the property.
The
public hearing was closed at 5:12 pm and the regular meeting resumed by a
motion made by Larry Barone and seconded by Floyd Dame. (5 ayes, 0 nays)
The
minutes of the October 14, 2015 meeting were approved as written by a motion
made by John Kenna and seconded by Molly Reilly.
In
further Board discussion of the Daniel St. Hilaire application 15-58Z, Molly
Reilly noted that the site drawing was inaccurate. Mr. St. Hilaire shared
pictures of the site that he had on his phone. It was noted that after
clarification of the setting in the picture, they could better understand the
desire for the position requested. Ms. Reilly wanted a better site drawing.
Chairman
Constance recommended that further discussion be tabled until an accurate plat
was provided showing all the buildings, trees and plantings and lot lines with
measurements and dimensions. Mr. St. Hilaire agreed. This should be provided
before the special meeting set for November 24, 2015 at 4:30 pm. A motion was
made by Jon Constance, seconded by Molly Reilly to table consideration until
the special meeting. (5 ayes, 0 nays)
Regarding
the area variance requested in application 15-56Z by Justin Wood, Larry Barone
raised the potential issues with the maintenance of the private access road on
Barn Alley. The existence of 3 sewer accounts and only 2 water meters was also
discussed.
It
was noted that an area variance needed to be considered by the Zoning Board of
Appeals before the Planning Board could consider the Special Use Permit at
their meeting on November 18, 2015.
A
motion was made by Floyd Dame, seconded by Larry Barone, to approve a 1,150
square foot variance with the condition that the Planning Board addresses the
other concerns about the application, including the water and sewer issue. (5
ayes, 0 nays)
A
motion to adjourn the meeting was made at 5:44 pm by Larry Barone, seconded by
Floyd Dame. (5 ayes, 0 nays)
