The meeting was called to order at 5:30 pm by Chairman Jon Constance. Members present: Jon Constance, Theodore Misiewicz, Floyd Dame, John Kenna, and Larry Barone.

 

Minutes from the June 21, 2016 meeting were approved as presented in a motion made by Floyd Dame, seconded by Theodore Misiewicz. Vote 5 ayes (Constance, Misiewicz, Dame, Kenna and Barone), 0 nays.

 

The meeting was opened for a public hearing at 5:32 pm in a motion made by John Kenna, seconded by Floyd Dame. Vote 5 ayes (Constance, Misiewicz, Dame, Kenna and Barone), 0 nays.  No comments were offered.

 

#15-38Z, Tobin Marti, 101 Monroe St: Applicant would like to construct a privacy fence on the property and requests a variance for a 6’ high fence. They have rescue dogs and would like a solid cedar fence that has a scalloped top edge.

A letter is attached to the application from a neighbor that does not oppose the fence.

 

Chair Constance read §4-8 C of the Village Zoning Law, that no front yard fence may exceed five feet.

 

A motion was made to accept the variance as presented by Jon Constance, seconded by John Kenna. Vote 0 ayes, 5 nays (Constance, Misiewicz, Dame, Kenna and Barone).

 

It was noted that zoning law allows a four foot fence next to the sidewalk or a six foot fence on the same line as the house.

 

A motion was made to agree that this is a Type 2 Action and to consent to let the Planning Board be the lead agency by Floyd Dame, seconded by John Kenna. Vote 5 ayes (Constance, Misiewicz, Dame, Kenna and Barone), 0 nays.

 

A motion to adjourn the meeting was made at 6:08 PM by Floyd Dame, and seconded by John Kenna. Vote 5 ayes (Constance, Misiewicz, Dame, Kenna and Barone), 0 nays.
