The meeting was called to order at 4:00pm by Chairman Jon Constance.
Members present were Jon Constance, Theodore Misiewicz, John Kenna, Larry
Barone and Floyd Dame.
Minutes
from the May 2, 2017 meeting were approved as presented in a motion made by
Theodore Misiewicz, seconded by Larry Barone. Vote 4 ayes, (Constance,
Misiewicz, Kenna and Barone) (1abstention Dame).
Minutes
from the September 5, 2017 meeting were approved with correction that the
letter from the Planning Board be attached to the minutes. Motion made by Floyd
Dame, seconded by John Kenna. Vote 3 ayes (Misiewicz, Kenna, Dame) (2
abstentions Constance, Barone).
Chairman Constance read the letter from the Planning Board
recommending that the variance be approved.
#17-24 Lawrence and Constance Barone, 411 General
Smith Drive, Sackets Harbor. Applicants request Subdivision Review to
create two lots from one parcel.
Applicants are requesting an area variance. The project is located in
the Village Residential Zoning District as well as the Historic Overlay and
National Register Districts.
A motion
was made to accept the variance as presented by John Kenna,
seconded by Theo Misiewicz. Vote 4 ayes, (Constance, Misiewicz,
Kenna and Dame) (1abstention Barone).
A motion
to adjourn the meeting was made at 4:08 PM by Floyd Dame, and seconded by Jon
Constance. Vote 5 ayes (Constance, Misiewicz, Dame, Kenna and Barone), 0 nays.

Barone Subdivision and Area Variance Request
At
this evening’s planning board meeting, we discussed the Barone application for
a minor subdivision. This project is
taking one parcel and dividing it into two, one of which would be
non-conforming. Both parcels have a
structure on them, identified as 408 and 411 General Smith Drive. The parcel identified as 411 General Smith
Drives is the lakefront home, recently sold from Rob Horr to Connie and Larry
Barone. That parcel is 7,161 square
feet, as surveyed in June. The other
parcel with the small structure identified as 408 General Smith is conforming.
Given the fact that the
lakeside home has existed for more than 30 years and has been part of the much
larger parcel across the street, including 408 General Smith Drive, the
planning board recommends granting the area variance requested.
We fully support this application.
The only other option we discussed to make the lot in compliance would
be to include a piece of property across the street; however in terms of
community and neighborhood planning, that does not really make much sense given
the nature of the neighborhood and location of other structures.
This
evening we tabled this application and we intend to take final action on it in
September after the Zoning Board of Appeals has considered the details of the
application for an area variance. If you
