The meeting was called to order at 5:04 pm by Chairman
Jon Constance. Members present John Kenna, Floyd Dame, and Larry Barone. Absent
Theo Misiewicz.
Minutes from the April 24, 2018 meeting were approved as
presented in a motion made by John Kenna, seconded by Floyd Dame. Vote 3 ayes
(Kenna, Dame, Barone), 1 abstain (Constance)
New Business
#18-15 Mark & Shayne
McWilliams, 118 N. Broad Street, Sackets Harbor. Applicant requests a side yard variance to build a garage. The
project is in the Village Residential Zoning District, Historic Overlay
District and National Register District and requires site plan review by the
planning board under the Zoning Law of the Village of Sackets Harbor.
The Public Hearing was opened by Chair Constance at 5:05
pm with a motion by Floyd Dame, seconded by Larry Barone, Vote 4 ayes (Kenna,
Dame, Barone, Constance). With no comments the public hearing was closed at
5:07 with a motion by Floyd Dame, seconded by John Kenna. Vote 4 ayes (Kenna,
Dame, Barone, Constance) 0 nays.
Chair Constance read the recommendation from the Planning
Board which stated “At last night's planning board meeting the board approved
the Site Plan application for Mark and Shayne McWilliams, with the condition
that any required area variances be granted, if deemed appropriate by the
ZBA. We conducted our SEQR review (no significant adverse impact on the
environment), held a public hearing and reviewed their application
materials. The project was unanimously approved, with that one condition.”
John Kenna made the motion to grant 3-1/2 foot variance
with a max of a 4 foot variance from the roof line or 5 feet from foundation,
seconded by Floyd Dame. Vote 4 ayes (Kenna, Dame, Barone, Constance) 0 nays.
A motion was made to
adjourn at 5:12 pm by Floyd Dame, seconded by Chair Constance. Vote
4 ayes (Kenna, Dame, Barone, Constance) 0 nays.
